1. Acceptance of Terms

trivolee is operated by Trivolee Studios LLC. By accessing or using trivolee ("the Service"), provided by Trivolee Studios LLC ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service. By creating an account, hosting a game, or participating as a player, you confirm your acceptance of these terms.

2. Description of Service

trivolee is a game platform that allows users to create, host, and play quizzes and games. The Service includes features for real-time multiplayer, solo play, sharing, and other interactive experiences.

3. AI-Generated Content

The Service offers optional AI-powered features to help generate quiz questions and validate answers. These features use third-party AI services to process your requests.

No Guarantee of Accuracy: AI-generated content is provided for convenience only. We make no representations or warranties regarding the accuracy, completeness, or reliability of AI-generated questions, answers, or validations. AI may produce incorrect, outdated, or misleading information.

User Responsibility: You are solely responsible for reviewing and verifying any AI-generated content before using it in your quizzes. By using AI-generated content, you accept full responsibility for that content as if you had created it yourself.

Content Processing: When you use AI features, your quiz topic, questions, and answers may be sent to third-party AI providers for processing. No personal account information is included in these requests. See our Privacy Policy for details.

4. Age Requirements

The Service is not intended for children under 13. You must be at least 13 years old to use trivolee. If you are between the ages of 13 and 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. We do not knowingly collect personal information from children under 13. If we learn that we have collected personal information from a child under 13, we will delete that information and terminate the associated account immediately.

5. User Accounts

Hosts must create an account to use certain features. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You agree to immediately notify us of any unauthorized use of your account.

Account Termination: We reserve the right to terminate accounts that remain inactive for extended periods or those that violate these Terms. Upon termination, you may lose access to all User Content, Trivia Coins, and Premium features without refund.

6. Paid Features and Virtual Items

6.1 Premium Subscriptions

trivolee offers optional paid premium subscriptions. Subscription fees are billed in advance and are non-refundable except as required by law. We reserve the right to change subscription fees with at least 30 days' notice.

6.2 Trivia Coins

The Service uses a virtual currency called "Trivia Coins" (TC) for certain features. Trivia Coins:

• Have no real-world cash value and cannot be redeemed for money;
• Are non-transferable between accounts;
• Are non-refundable once purchased or earned;
• May expire if the account is terminated or inactive.

7. Acceptable Use Policy

You agree NOT to use the Service to:

• Upload, share, or create content depicting child sexual abuse material (CSAM) or any exploitation of minors
• Engage in bullying, harassment, hate speech, or threats against any person or group
• Share content that is defamatory, obscene, or promotes violence
• Impersonate any person or entity, or falsely represent your affiliation
• Share personal information of others without their consent
• Distribute spam, malware, or engage in phishing
• Violate any applicable laws or regulations
• Interfere with or disrupt the Service or servers
• Use the Service for any illegal purpose

Violations of this policy—especially those involving illegal content such as CSAM—will result in immediate account termination and may be reported to law enforcement authorities.

8. Marketing Communications

By creating an account on the Service, you agree to receive promotional emails from Trivolee, including new feature announcements, product updates, and special offers related to the Service.

By participating in a business partner's features on the Service — such as playing partner quizzes, earning points, or redeeming rewards — you also agree to receive promotional emails from Trivolee on behalf of that partner. These may include new quiz announcements, reward offers, and program updates. Business partners do not have access to your email address and do not contact you directly.

All marketing emails are limited to a reasonable frequency.

You may opt out of marketing emails at any time by using the unsubscribe link included in every email or by contacting us at help@trivolee.com. Opting out does not affect service-related communications (such as account or security notifications).

9. User-Generated Content

Users may create quizzes, upload images, and submit content ("User Content"). You retain ownership of your content but grant Trivolee Studios LLC a non-exclusive, worldwide, royalty-free, sublicensable license to use, display, host, and distribute your content solely for the purpose of operating and improving the Service.

Section 230 Immunity: Trivolee Studios LLC is a provider of an "interactive computer service" under the Communications Decency Act (47 U.S.C. § 230). As such, we are not the publisher or speaker of any User Content and cannot be held liable for any such content provided by third-party users.

Disclaimer of Responsibility: You are solely responsible for all User Content you create, upload, or share. We do not monitor, endorse, or verify User Content. We specifically disclaim all liability for any photos, questions, or other materials uploaded by users. You represent that you have the right to upload any User Content and that it does not infringe on any third party's rights.

Content Removal: We reserve the right, but have no obligation, to remove or disable access to any User Content that violates these Terms or that we deem inappropriate, at our sole discretion and without prior notice.

10. Reporting Violations

If you encounter content that violates these Terms, please report it to us immediately at help@trivolee.com. We will investigate and take appropriate action, which may include content removal and account termination.

11. Data Retention and Persistence

On trivolee, we use the terms "quiz" and "game" to describe your creations and activities. To keep our platform fast and efficient, data is not stored indefinitely for all users:

Expiration: For standard users, quizzes and their associated game results (including scores, player answers, and leaderboards) are permanently deleted approximately three (3) weeks after they have expired.

Premium Benefit: Quizzes and results created by Premium subscribers do not expire, subject to account standing and an active subscription.

No Warranty of Persistence: While we aim to keep your content available, we do not guarantee that your quizzes, games, or data will be stored forever. You are responsible for maintaining your own backups. We are not liable for the deletion or loss of any user-created quizzes, scores, or data.

12. Intellectual Property

The Service, including its design, features, and branding, is owned by Trivolee Studios LLC and protected by copyright and other intellectual property laws. You may not copy, modify, or distribute any part of the Service without our written permission.

13. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. YOUR USE OF THE SERVICE IS AT YOUR OWN RISK.

No Warranty of Accuracy: trivolee provides content, quizzes, games, and features—-including but not limited to User Content, AI-generated materials, and Daily Quizzes—-for entertainment purposes only. This disclaimer applies to all existing and future content and features provided through the Service. We do not warrant, endorse, or guarantee the accuracy, reliability, or completeness of any questions, answers, facts, or other information presented.

AI Disclaimer: Without limiting the foregoing, AI features are provided for convenience only and may produce inaccurate, incomplete, or misleading results. You are responsible for verifying any AI-generated content before use.

14. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, TRIVOLEE STUDIOS LLC AND ITS MEMBERS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO DAMAGES RESULTING FROM:

• Any content, questions, answers, images, or features provided by users or through the Service
• Reliance on any quiz content, facts, or information presented on the Service
• AI-generated or AI-validated content, including any inaccuracies or errors therein
• Interactions with other users
• The loss of any data, specifically quizzes, games, scores, or user-created content
• Any conduct of third parties on the Service

15. Indemnification

You agree to indemnify, defend, and hold harmless Trivolee Studios LLC and its members, officers, and employees from any claims, liabilities, damages, losses, and expenses (including legal fees) arising from your use of the Service, your User Content, your violation of these Terms, or your violation of any rights of another party.

16. Modification and Termination of Service

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We shall not be liable to you or any third party for any such modification, suspension, or discontinuance.

Upon termination of your account, your right to use the Service will cease immediately.

17. Changes to Terms

We may update these Terms from time to time. If we make material changes, we will notify users through the Service or by other means. Your continued use of the Service after changes constitutes acceptance of the new Terms.

18. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

19. DMCA Copyright Policy

We respect intellectual property rights. If you believe your copyright-protected work has been posted on our Service without authorization, please notify our Designated Copyright Agent at help@trivolee.com with the following information:

• Identification of the copyrighted work claimed to have been infringed;
• Identification of the material that is claimed to be infringing and where it is located;
• Your contact information (name, address, telephone number, and email);
• A statement that you have a good-faith belief that use of the material is not authorized;
• A statement that the information in the notification is accurate and, under penalty of perjury, that you are authorized to act on behalf of the owner.
